Pedestrian Accident Attorney
Las Vegas sees more than our fair share of pedestrian accidents and fatalities. Whether it’s due to poorly marked walkways, impaired drivers, distracted pedestrians, or any other number of factors, every incident is unique. At Hale Injury Law we represent pedestrians that have been struck by motorists, and in some instances, motorists that have struck pedestrians.
Determining Fault in Pedestrian Accidents
Fault may be challenging to determine in a pedestrian accident as it is not always cut and dry. Most parties assume that just because a pedestrian was on a sidewalk that the motorist is at fault, which isn’t always the case. The factors that help to determine fault may include more than the location of the sidewalk and static or digital signage, and can be major when considering the outcome of your case.
Pedestrian Fatalities on the Rise
The United States saw a rise in pedestrian fatalities in 2016 and we are expecting to see this trend continue for several years. Contributing to the increase in pedestrian fatalities is motorist distractions from the use of smartphones and smart devices among others. Nevada, and especially Las Vegas, is still among the top of the list for most fatal states for pedestrians. Still, nearly three-quarters of all pedestrian accidents occur between the hours of 6 pm and midnight, prime time on busy walkways in most tourist corridors, such as the Las Vegas Strip.
Authorities in Las Vegas are continually working to improve the conditions and make The Strip safer for tourists. One project they continue to work in is building walkways above street level moving pedestrians away from streets. Despite their efforts, pedestrian accidents continue to rise, and so do the fatalities associated with them.
